Personal Injury - Frequently Asked Questions

NO WIN NO FEE CLAIM - what does this mean?

This means that we deal with your claim for compensation for FREE, even if your claim is not successful. This type of arrangement is called a Conditional Fee Agreement.

If you win your claim the party at fault or usually their insurance company pay our costs together with your compensation.

If you lose your claim you would normally be responsible for your opponents costs and your own Solicitors costs as the general rule is that the loser of a Court case pays the costs of the winner. However, in a Conditional Fee Agreement or a No Win No Fee claim we will arrange an insurance policy to cover the situation if your claim is unsuccessful and the opponents costs will be paid from this insurance. However, there is no cost to you for taking out this insurance policy.

100% Compensation?

YES. We guarantee that you will receive all of your compensation. We do not make ANY deductions from the money we recover on your behalf.

I am a member of a Trade Union. Does this matter?

NO. If you are a member of a trade union our Solicitors can still represent you at NO COST TO YOU. You will keep all of your compensation. We do not make any deductions.

Do I have to pay for court fees and medical report fees and expenses?

NO. We pay these on your behalf and normally they are recovered against the losing party/their insurers.

What if I already have legal expenses cover from an insurance company?

Sometimes you will find that you may already have some sort of legal expenses insurance by way of a household policy, motor policy, travel insurance or a separate policy. This policy may provide some legal cover for you but it does not always provide all the protection you need to bring a claim for compensation to protect yourself if your claim is unsuccessful. Our Solicitors will discuss in detail with you any existing legal expenses cover you may have.

Is there a time limit to bring a claim?

YES. A Claim Form must be issued at Court within THREE YEARS of the date of the accident.

In claims for INDUSTRIAL DISEASE this time limit is slightly different. The three year time limit is extended. The period begins to run from the date when a person has knowledge of or first became aware that the disease from which they are suffering has been caused by that person's working environment. This is particularly important in cases involving exposure to asbestos as this disease can be dormant for over 30 years.

In claims involving CHILDREN a Claim Form must be issued at Court by that child's 21st BIRTHDAY. i.e. if your child suffers an accident when only 5 years of age, then you have another 16 years to ensure that a Claim Form is issued at Court at the latest.

How much compensation will I receive?

This depends upon the nature of your injuries and how long your symptoms will last.

It is misleading to be advised at the beginning of your claim of a sum of money you are likely to receive as each person's injuries are different.

A medical report will need to obtained and once this medical expert has advised as to nature of your injuries and how long your symptoms are likely to laslt, it is then that an approximate value can be placed on your claim.

See our VALUE YOUR CLAIM DIAGRAM and INJURY TYPE SECTION for general guidance.
