How successful is debt collection?

Sometimes we are able to recover 100% of the outstanding sum by simply sending the debtor a letter before action.

Normally over 80% of letters before action result in the debtor making payment.

However, other debtors may be more difficult and Court proceedings may need to be issued to try and obtain payment.

Why issue Court proceedings?

If a debtor fails to respond to a letter before action it is recommended that Court proceedings are issued because:-

Once served the debtor must respond within a time limit or Judgment can be entered against him
It can include interest and legal costs depending on the amount of the debt
It can be used for any sum of money whether small or large
Once a Judgment is obtained then different methods of enforcing the debt can be made
If the debtor disputes the debt then he has to provide his reasons in detail and is subject to a strict timetable by the Court

Methods of enforcement

If Court proceedings are issued and a Judgment is obtained against the debtor then the Judgment can be enforced and payment obtained by a number of different means:

Warrant of Execution - the Bailiff will attend at property owned by the debtor and seize and sell this goods
Oral Examination - this requires the debtor to provide you with specific information about this financial position and assets
Charging Order - a Charge can be registered at the Land Registry against any property or land owned by the debtor
Attachment of Earnings - the debt can be paid out of the debtors earnings if he is employed
Third Party Creditor - the debt due to the debtor by another person can be paid direct to you
Garnishee Order - the debtors bank account will be debited with the amount of the debt due

Are there other methods of forcing payment?

If the debtor owes £750.00 or more then Bankruptcy proceedings can be made. A Statutory Demand is served on the debtor and has serious consequences if it is ignored. This is only recommended where there is certainty that the debt cannot be disputed. It is a very effective way of forcing a debtor to pay.
